2025 REAL INSURANCE HARBOUR 10 – PARTICIPANT AGREEMENT
I acknowledge that: I am participating in the Real Insurance Harbour 10 (including the race(s), expo / race bib pick up, and all other activities related thereto) (Event) voluntarily at my own risk. The Event is being conducted through the involvement of Pont3 Pty Ltd (Pont3) and Greenstone Financial Services Pty Ltd trading as Real
Insurance (Real Insurance). The ‘Event Organiser’ means Pont3 and the ‘Naming Rights Sponsor’ is Real Insurance. I recognise that participation in the Event is a potentially hazardous activity and I willingly assume all risks associated with such participation, including, but not limited to, illnesses; contagious diseases; physical, emotional, or mental injuries; falls; contact with other participants, spectators, volunteers, Event staff, directors, employees, agents, or others; vehicular or other traffic accidents or collisions; the effects of the weather, including heat and/or humidity, wind, cold, and wet, damaged or slippery surfaces; falling tree branches or other overhead objects; the crowded nature and other conditions of the course; all such risks being known and appreciated by me and I voluntarily assume all such risk. I will take all reasonable measures to protect myself from the risks of participation. I release the organiser from all liability, including any injuries or damages sustained, irrespective of the cause. I accept all responsibility for travel and personal medical insurance and for payment and/or reimbursement of medical/surgical expenses including (potential) hospital transport costs incurred because of my participation in the Event.
I am responsible for all property I bring to the Event sites and acknowledge that Pont3
Pty Ltd (the Event Organiser) and Greenstone Financial Services Pty Ltd trading as Real Insurance (Naming Rights Sponsor) accepts no responsibility for any loss or damage to this property.
I consent to the conduct of identity verification checks, background security checks and any other security checks (which may include inspecting my personal property) prior to my entry to and / or departure from any Event sites.
I will abide by the Event rules and timelines, as varied from time to time, and will abide by directions given by Event Officials and accept that the Event Organiser has discretion to accept or decline an entry on whatever grounds.
I undertake to comply with all applicable regulations, by laws and rules of Sport Integrity Australia (SIA) and World Athletics (WA) in relation to the Event and will comply with all reasonable directions and decisions of the officials, and other representatives of SIA, WA and the Event Organiser’s staff, volunteers, contractors and officials.
I will abide by the rules of the event and the rules of the Governing authority of the sport, World Athletics, by which the Event is conducted.
In consideration of the Event Organiser accepting my application for entry to the Event, I, to the extent permitted by law:
- release the Event Organiser and where relevant the Naming Rights Sponsor (and its directors, officers, employees, volunteers, contractors, sponsors and / or agents) from all Claims that I may have or may have had but for this Agreement arising from or in connection with the Event and/or my participation in the Event; and
- indemnify and will keep indemnified the Event Organiser and where relevant the Naming Rights Sponsor (and its directors, officers, employees, volunteers, contractors, sponsors and / or agents) in respect of any Claim by any person arising as a result of or in connection with the Event and/or my participation in the Event.
Claim means and includes any action, suit, proceeding, claim, demand, damage, cost or expense (including legal fees) however arising including any claims resulting from the participants’ actions but not limited to negligence.
I consent to the publication and/or use in any form of media whatsoever of my name, race result, image, voice, public registration confirmation, statement or otherwise, including the publication of my name and/or event result and applicable age bracket in / or marketing materials / website without payment or compensation or liability for how such media is used.
To the best of my knowledge, I am not suffering from a condition which would prevent and/or render me unfit to participate in the Event. I warrant that I am physically and medically fit to participate in the Event and take full responsibility for any health risks involved. I release the Event Organiser from all Claims, damages, or losses arising from or in connection with my participation, regardless of cause. I have not knowingly used any substance for the purpose of enhancing my performance at the Event and will not use any substance or procedures prohibited by the rules of AA or World Athletics (“WA”). (Competitors should check with their physician to ensure medication that they are taking is not a prohibited substance). I grant the Releasees and their designees, including any appointed Event Medical Director, permission to administer or arrange for any medical assistance that they deem necessary or appropriate as a result of my participation in the Events, including without limitation, arranging transportation to a hospital or other medical facility. I also grant the releasees access to my medical records and physicians, as well as other information, relating to medical care that may be administered to me at any such medical facility as a result of my participation in the Events. I release the Event Organiser from any liability arising from medical treatment provided during the Event.
Any child under the age of twelve (12) must be accompanied by an adult at all time on course and within the Venue.
I understand that there is a time limit in which I am required to complete the Event. If, during the conduct of the Event, an Event official directs my withdrawal because I am likely to be unable to reach the cut-off marks within the advertised time limit or complete the Event within the advertised time limit, I undertake to comply with this direction. In these circumstances I will voluntarily remove myself from the course without liability to the organisers.
All entry fees are strictly non-refundable for non-starters and non-finishers and nontransferable under any circumstances, including but not limited to duplicate entry, participant error, withdrawal, non-attendance, visa rejection, exceeding the course time limit or event cancellation.
Entries are refundable under the Race Roster Enhanced Refund Protection Program should the option be purchased by the participant during registration. For the avoidance of doubt, this Event Refund Program (“Program”) is administered by Protecht, Inc. on behalf of the registration seller Race Roster and is not an agreement or insurance policy with Pont3 Pty Ltd or Real Insurance Harbour 10 (“Organiser”). The Organiser is not a party to this Program, does not endorse or assume any liability for refunds, and has no involvement in evaluating, approving, or processing refund requests. By participating in this Program, you acknowledge that all refund determinations are solely the responsibility of, Race Roster and that the Organiser bears no responsibility or liability for any refunds, claims, or disputes arising from this Program. For any questions or claims under this Program, please direct all inquiries to Protecht, Inc., who administers this program by contract for Race Roster. By purchasing refund protection, you are adding the refund protection fee to your checkout cart. You acknowledge this is not insurance, and you agree to the Terms & Conditions of this seller’s conditional refund promise. The purchase of refund protection is only valid for the event and year the participant purchased it and cannot be transferred to another year or event. Should the refund protection not be used, there is no refund on the refund protection fee. Protecht, Inc’s Terms and Conditions and Privacy Policy are available on their website..
Entry fees will be processed by the Event Organiser, and an item will appear on your statement showing funds being debited by the 2025 Real Insurance Harbour 10.
Race deferrals are only offered to expectant parents under our Pregnancy and Postpartum Policy.
I accept that the event will be subject to the current NSW Health guidelines, which I agree to abide by any decisions made by the Event Organisers as a result of NSW Health directives or advice. If the Event is cancelled for safety concerns or otherwise as a result of something beyond the reasonable control of AA and / or Pont3 including and without limitation strong winds, heavy rain, excessive atmospheric pollution, lightening and accidents, force majeure, pandemic or other mass health and safety issues, or any other Act of God, I accept that my entry fee and/or any other cost incurred in order to participate and / or get to the Event will be non-refundable. In addition, I acknowledge I will have no claim against the Event Organiser for any loss or damage I may suffer because of such cancellation.
I certify that I am 18 years or older, or that I am the parent/legal guardian of the Participant who is under the age of 18 years and that I have prior written approval from the Event Organisers for my child or guardian to run, and I have read this document and fully understand it. As a parent or legal guardian, I agree to this Participant Agreement for and on behalf of the Participant.
Privacy Declaration: Pont3 Pty Ltd collects, uses and discloses personal information for the purposes of conducting and administrating the Event and other related activities, including for identifying participants, recording results, and communicating with you, and for providing you with member services or promotional material such as other events or other sponsor offers. Pont3 collects, uses and discloses personal information in accordance with Pont3’s privacy policy.
I agree to the following as conditions of participating in any of the events that make up the Real Insurance Harbour 10 (“Event”). Event means any of the events within the Real Insurance Harbour 10. Pont3 may share your information with third parties as required, including but not limited to disclosing your personal information to Athletics Australia Ltd for the purpose of administering the Athletics Australia Running Australia program. In administering the Running Australia program, your personal information will be used to register you as a recreational running member of Athletics New South Wales.
The Pont3 privacy policy contains information about how to access and correct personal information held by Pont3 or how to make a complaint about the handling of personal information. Applications or services may be rejected if requested information is not provided. Opt-out procedures are available for individuals wishing to avoid receipt of promotional material from Pont3 or third parties. Contact information for Pont3 and a copy of our privacy policy is available at Privacy Policy – Pont3 Pty Ltd.
Real Insurance uses and discloses personal information in accordance with the Real Insurance Privacy Policy. Real Insurance may contact you in the future in relation to this event, other promotions, special offers and promoting and marketing goods and services of Real Insurance, including by email, mail and where you have provided express consent, by telephone. This authority lasts until you opt out of direct marketing by contacting Real Insurance. You consent to Real Insurance using your personal information in accordance with Real Insurance’s Privacy Policy.
Promo code: To validate your promo code, enter the code in the promo box on the checkout page. If your code is accepted, your registration fee will be reduced accordingly. Promo codes may only be used where the Participant meets the conditions applying to the code and uses it within the validity period. Promo codes are only valid for the distance indicated and cannot be transferred under any circumstance. Promo codes are not able to be redeemed or exchanged for cash and must only be used by the Participant(s) to whom the relevant code was issued to by the code owner. No refunds will be issued if you submit payment and fail to enter your code during the registration process. Notwithstanding of the expiry dates provided for promo codes, Pont3 reserves the right to modify, suspend and/or cancel any voucher code at any time without notice to Participants.
Promo giveaway codes are only valid for the sub-event (distance) indicated.
I have read this waiver/release, and I fully understand its terms and conditions and understand that I am giving up substantial rights, including my right to bring actions against the releasees. I acknowledge that I am signing the waiver/release freely and voluntarily, and that I intend by my signature to completely and unconditionally release the releasees to the fullest extent allowed by law.
I expressly agree that this waiver/release is intended to be as broad and inclusive as permitted by the laws of New South Wales and that this waiver shall be governed by and interpreted by the laws of New South Wales. I agree that in the event that any clause or provision of this waiver/release shall be held to be invalid, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this waiver/release, which shall continue to remain in full force and effect.
